Terms and Conditions
Please read these terms and conditions (“Terms”) carefully. These Terms (in their entirety) are a binding agreement between you and Vail Corporation d/b/a Vail Resorts Management Company (“Vail Resorts”, “we” or “us”).
ADVISORY
YOU ARE ADVISED THAT A CLASS ACTION LAWSUIT HAS BEEN FILED AGAINST VAIL RESORTS AND ITS AFFILIATES, CONTRACTORS, REPRESENTATIVES, OR AGENTS REQUESTING REFUNDS AND OTHER COMPENSATION IN CONNECTION WITH RESORT OPERATIONS AT PARK CITY MOUNTAIN FROM DECEMBER 27, 2024 THROUGH JANUARY 8, 2025. SECTION 8 OF THESE TERMS INCLUDES A RELEASE BY WHICH YOU WILL FORFEIT ANY RIGHTS YOU HAVE IN THAT LAWSUIT OR OTHER CLAIMS YOU MAY HAVE RELATED TO RESORT OPERATIONS AT PARK CITY MOUNTAIN FROM DECEMBER 27, 2024 THROUGH JANUARY 8, 2025.
TERMS

1. Overview. We value the commitment and loyalty of our customers. We also share your disappointment that resort operations at Park City Mountain were negatively impacted by a ski patrol union strike that began on December 27, 2024 and lasted through January 8, 2025 (the “Eligible Period”). To supplement our existing refund policies, we want to honor your continued loyalty by providing eligible guests that used a pass or lift ticket during the Eligible Period with an individualized credit toward your pass purchase for the 2025/2026 season, subject to the terms and conditions set out below. We developed this program to provide you with a credit that reflects your individual experience, and we hope you will continue to enjoy the mountains with us.
YOU ARE NOT OBLIGATED TO ACCEPT THIS CREDIT. IF YOU CHOOSE TO DO SO, YOU WILL BE RELEASING CERTAIN RIGHTS YOU MAY HAVE, AS EXPLAINED IN SECTION 9 BELOW.

2. Eligibility. This section sets out the requirements that you must meet in order to be eligible for a credit towards the purchase of a pass for the 2025/2026 season (the “Credit”).

Three Requirements for Eligibility. In order to be eligible to receive a Credit, you must satisfy the following three requirements:

Eligible Pass or Lift Ticket. You must have paid in full for an eligible pass or lift ticket for the 2024/2025 season (“Eligible Lift Access Product”). The full list of Eligible Lift Access Products can be found here.

Eligible Period. You must have used an Eligible Lift Access Product at Park City Mountain during the Eligible Period.

No Refund. If you obtain, or have obtained, a full or partial refund for your pass or lift ticket with respect to use or nonuse during the Eligible Period you are not eligible for a Credit. For those individuals who have an unresolved refund claim, your eligibility for a Credit will be put on hold until your refund claim is resolved. If your refund claim results in a full or partial refund, you will not be eligible for a Credit. If your refund claim is denied, we will send an email to you with your Credit amount and information on how to redeem the Credit.

3. The Amount of Your Credit. This section describes how Vail Resorts determines the amount of your individualized Credit, if you meet the three eligibility requirements above.
a. Overview. We determine the amount of your individualized Credit based on two factors: (1) the type of Eligible Lift Access Product you purchased for the 2024/2025 season and the value of that product, (2) the number of days you used your Eligible Lift Access Product at Park City Mountain between December 27, 2024 and January 8, 2025.
b. General Season Pass Holders. A “General Season Pass” is one that is not limited to a fixed number of days during the season; examples are the Epic Pass and Epic Local Pass. This section explains how your Credit is calculated if you bought a General Season Pass for the 2024/2025 season and meet the eligibility requirements above.

Your Credit will be a dollar amount determined as a percentage of the Purchase Price of your 2024/2025 pass. The “Purchase Price” is the amount you paid for a 2024/2025 pass, net of any discounts, promotions, credits and taxes. The percentage used to calculate the Credit will vary based on the number of days you used your 2024/2025 pass at Park City Mountain during the Eligible Period, as follows:

Example 1: If you purchased a 2024/2025 EPIC Pass for $999 and used your pass 5 days at Park City Mountain during the Eligible Period (and otherwise meet the eligibility requirements above), you would receive an individualized Credit of $309.69 (i.e., 31% of $999) towards the purchase of EPIC pass product for the 2025/2026 season.
c. Fixed Season Pass Holders. This section explains how your Credit will be calculated if you bought a Fixed Season Pass, such as an Epic Day Pass, and meet the eligibility requirements above. An Epic Day Pass gives the holder a fixed number of days to use the pass each season, usually ranging from 1 to 7 days, which are not required to be used on specific dates. Your Credit will be a dollar amount determined as a percentage of the Purchase Price of your 2024/2025 pass. The “Purchase Price” is the amount you paid for a 2024/2025 pass, net of any discounts, promotions, credits and taxes. The percentage used to calculate the Credit will vary based on your Fixed Season Pass type and the number of days you used your 2024/2025 pass at Park City Mountain during the Eligible Period, as follows:
Example 2: If you purchased a 2024/2025 Epic 7-Day Pass for $731 and used your pass 5 days at Park City Mountain during the Eligible Period (and otherwise meet the eligibility requirements above), you would receive an individualized Credit of $263.16 (i.e., per Table 3 above, a 36% Credit of your Purchase Price of $731) towards the purchase of your 2025/2026 pass.
d. Lift Ticket Holders. This section explains how your Credit will be calculated if you bought a Lift Ticket and meet the eligibility requirements above. A Lift Ticket gives the holder a fixed number of days to use the ticket each season and are required to be used on specific dates.

Your Credit will be a dollar amount determined as a percentage of the Purchase Price of your 2024/2025 ticket. The “Purchase Price” is the amount you paid for a 2024/2025 ticket, net of any discounts, promotions, credits and taxes. The percentage used to calculate the Credit will vary based on your Lift Ticket type and the number of days you used your 2024/2025 ticket at Park City Mountain during the Eligible Period, as follows:
Example 3: If you purchased a 3-Day Lift Ticket for $400 and used your pass 2 days at Park City Mountain during the Eligible Period (and otherwise meet the eligibility requirements above), you would receive an individualized Credit of $133.33 (i.e., a 33% Credit of your Purchase Price of $400) towards the purchase of your 2025/2026 pass.

4. Use of the Credit.

Using Your Credit Generally. You will need to input a unique promotional code at checkout to activate your individualized Credit. If you are eligible for the Credit, we have emailed you your unique promotional code at the addresses we have on file. If you did not receive an email and believe that you are eligible for the Credit, please use our online form to submit an inquiry for a credit. We update the currency conversion rate once a month, and the currency conversion rate we have on file at the time of your request will be applied to your currency conversion.

Auto-Renew Pass Holders. If you are enrolled in our Auto Renew Program and you are eligible for a Credit, we will email you after April 15, 2025 with directions regarding how to accept these Terms. You will need to accept these Terms before August 15, 2025 to have the credit automatically applied. After you have accepted these Terms, the Credit you have received will be applied to your remaining final payment due in September 2025.

Online Purchases. You may redeem your Credit at epicpass.com or resort websites by inputting your unique promotional code during the checkout process.

Phone Purchases. You may redeem your Credit by calling our pass experts at +1-970-754-0005 and providing your unique promotional code during the checkout process.

Travel Agency. You may redeem your Credit if you buy your pass through a travel agency by providing your travel agent with the unique promotional code to apply during the checkout process.

5. Limited Redemption. You can only redeem your Credit towards the purchase of a single pass for the 2025/2026 season. You cannot use your Credit on any other product or service offered by Vail Resorts and its affiliates. You also cannot redeem any portion of your Credit for cash. If the pass you purchase for the 2025/26 season costs less than your Credit, the remaining portion of the Credit will be forfeited. You may not combine your Credit with any other promotional offer.

6. Time Limitations. You must use your Credit while passes for the 2025/2026 season are on sale through epicpass.com, or by November 30, 2025, whichever is earlier. If you fail to use your Credit by that time, your Credit will expire and be forfeited.

7. Non-Transferable. Your Credit is non-transferable and cannot be transferred to a family member, friend, or any other individual.

8. Release of Claims. You are not obligated to use your Credit. If you choose to use your Credit toward the purchase of a 2025/2026 pass product, you are thereby voluntarily and knowingly agreeing, to the maximum extent permitted by applicable law, to waive, release, and forfeit any and all claims and actions you have or may have against Vail Resorts, or any of its resorts, subsidiaries, affiliates, or Partner Resorts and any of our or their respective officers, directors, employees, contractors, representatives, insurers, or agents (collectively, the “Vail Resorts Parties”) and any associated losses, damages and expenses (including attorneys’ fees), that relate to, arise out of, or may arise out of the operation of Park City Mountain between December 27, 2024 and January 8, 2025, including claims you may have for any other or additional form of refund, credit, or compensation relating to or arising from resort operations during that period. This release includes such claims against Sedgwick Claims Management Services, Inc., which administers Epic Coverage.
If you are a California resident, you waive California Civil Code Section 1542, which says: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.” If you are a resident of another jurisdiction, you waive any comparable statute or doctrine.
NOTICE OF CLASS ACTION LAWSUIT:
We hereby advise that a class action lawsuit has been filed against Vail Resorts Inc. on behalf of guests in connection with operations at Park City Mountain from December 27, 2024 through January 8, 2025, seeking refunds and other alleged damages. This lawsuit is currently pending in the United States District Court for the District of Utah under the caption Bisaillon v. Vail Resorts, Inc., No. 25-cv-00020. The complaint and contact information for plaintiffs’ counsel can be found here. THIS RELEASE AND THESE TERMS WILL AFFECT ANY RIGHTS YOU HAVE IN CONNECTION WITH THAT LAWSUIT AND ANY SIMILAR LAWSUITS THAT HAVE BEEN OR MAY BE FILED. IF YOU HAVE ANY QUESTIONS REGARDING THE IMPACT OF THESE TERMS OR THIS RELEASE ON YOUR LEGAL RIGHTS, YOU SHOULD CONSULT WITH A LAWYER.

9. LIMITATION OF LIABILITY. YOU UNDERSTAND AND AGREE THAT TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, IN NO EVENT WILL ANY OF THE VAIL RESORTS PARTIES BE LIABLE UNDER ANY THEORY OF LIABILITY (WHETHER IN CONTRACT, TORT, STATUTORY, OR OTHERWISE) FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PERSONAL INJURY/WRONGFUL DEATH, PUNITIVE, OR EXEMPLARY DAMAGES (EVEN IF SUCH PARTIES WERE ADVISED OF, KNEW OF OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES), INCLUDING BUT NOT LIMITED TO AS A RESULT OF: YOUR USE OF OR INABILITY TO USE ANY OF YOUR ELIGIBLE 2024/2025 PASSES OR LIFT TICKETS AT PARK CITY MOUNTAIN DURING THE ELIGIBLE PERIOD, YOUR PURCHASE OF 2024/2025 PASSES, OR YOUR CREDIT. NOTWITHSTANDING THE FOREGOING, THE TOTAL AGGREGATE LIABILITY OF THE VAIL RESORTS PARTIES TO YOU WILL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR ELIGIBLE 2024/2025 PASS(ES) IN THE AGGREGATE.

10. Exclusions and Limitations. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations and disclaimers may not apply to you. To the extent that we may not, as a matter of applicable law, limit our liabilities, the extent of liability of the Vail Resorts Parties will be the minimum permitted under such applicable law. We disclaim any warranties to the maximum extent permitted under applicable law.

11. Disputes. These Terms and the relationship between us will be governed by the laws of the State of Colorado in the same manner as such laws are applied to agreements made, entered into, and performed entirely in Colorado. All lawsuits or claims arising out of or relating to these Terms (including any Credit) must be brought in the Federal or State courts located in Colorado. We and you hereby irrevocably submit to the exclusive personal jurisdiction of such courts for such purpose and waive any objection to such courts on any basis, including without limitation improper venue or inconvenience of the forum. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to these Terms (including any Credit) must be filed within one (1) year after such claim or cause of action arose or be forever barred.

12. Severability. If any provision of these Terms is found by a court of competent jurisdiction to be invalid, you nevertheless agree that the court should endeavor to give effect to our intentions as reflected in the provision, and that the other provisions of these Terms remain in full force and effect.

13. Electronic Communications Notice. When you use our website or send emails to us, you are communicating with us electronically. You consent to receiving communications from us electronically. We may communicate with you by email or posting notices on the applicable website. You agree that all agreements and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. In order to access any such communications, you must have a computer or other Internet-enabled device. In order to retain copies of any such communications, you must have a printer or data storage device. If you have a printer, you may print paper copies of any such communications for your own use. If you wish to withdraw your consent for us to communicate with you electronically, you may not use our website.

14. Acceptance. YOUR ACCEPTANCE OF THE CREDIT CONSTITUTES YOUR AGREEMENT TO THESE TERMS, INCLUDING THE RELEASE SET FORTH IN SECTION 8 ABOVE.

Anyone who skied or snowboarded with a pass or lift ticket at Park City Mountain between December 27, 2024, and January 8, 2025, is eligible.
Guests who used one of the following products during this time will not be eligible for credits: Ski and Ride School add-on lift tickets, complimentary tickets or passes, employee coupons, recreation tickets, employer-provided passes or vouchers, trade partner products.
Please note, if you have already received a complimentary ticket, coupon in-resort, or refund for your lift ticket, we are unable to provide you with further credits. We sincerely appreciate your understanding as we work to assist all impacted guests.
Pass Holders: To address the on-mountain experience, we are providing all Pass Holders a 50% credit per day skied or snowboarded at Park City Mountain between December 27, 2024, and January 8, 2025, to apply toward the purchase of a 2025/26 pass of equal or greater value to their 2024/25 pass. Season pass per-day credits are calculated based on eight days, and Epic Day Pass per-day credits are calculated based on the number of days purchased. The minimum credit amount these Pass Holders will receive is 25% of the total purchase price of their 2024/25 pass. All credits will be customized for Pass Holders based on the price of their 2024/25 pass, product type, and number of days skied between December 27, 2024, and January 8, 2025.
Lift Tickets: To address your experience on the mountain, we are providing a 50% credit of the price paid for each day of lift tickets you used to ski or snowboard at Park City Mountain between December 27, 2024, and January 8, 2025, to apply toward the purchase of a 2025/26 pass product (full-season pass or Epic Day Pass) of equal or greater value to your credit amount.
In March, eligible guests will receive a personalized email with their specific credit and promotion code.
Lift ticket guests can apply credits toward the purchase of a 2025/26 pass product of equal or greater value to your credit amount online. If you want to purchase a pass that is less than your credit amount, you should call 970-754-0094 for assistance after 2025/26 passes go on sale.
Please note: If the price of the new product is lower than the value of your credit, the difference will not be refunded.
Guests who are enrolled in Auto Renew for eligible Epic Pass products will be automatically renewed for the 2025/26 ski and ride season around early April 2025, at the guaranteed lowest price, with the most benefits. You will be charged $49 when your pass is renewed, with the remainder of the payment processing in September 2025. After the initial charge, we will notify you with instructions on how to apply your renewal credit before process your final payment in September.
